Consent and Waiver

Conditions of entry — please read before proceeding

  • No non-vegetarian food or beverages

  • Anyone in violation will be asked to leave immediately

Who this form covers

By completing and signing this form, you are agreeing to its terms on behalf of yourself, any minor children in your care,  any other individuals in your group for whom you are registering, and hosting an event at Texas Gaushala. This form applies to all current and future events, sessions, and services at Texas Gaushala, including but not limited to cow cuddling, cow feeding, picnics, field trips, yoga, events and other workshops.

Activities and animals

Texas Gaushala hosts a variety of activities involving direct contact with animals and physical participation. Animals present on the property include, but are not limited to, cows, peacocks, dogs, and cats.

All animals — including miniature breeds — are living, unpredictable creatures. Cows can weigh several hundred pounds and may spook, kick, bite, or step on guests without warning. You agree to follow all posted rules and staff instructions to minimize the risk of accident or injury to yourself, your children, and your belongings.

Physical activities such as yoga and sports are also offered. Participation in any activity is entirely voluntary.

Health and fitness

By signing this form, you represent that you and each member of your group are in good physical health and have no medical condition that would limit safe participation in the activities offered at Texas Gaushala. It is your responsibility to consult a physician before and after participating, if appropriate.

You agree to be aware of your own limitations, use common sense, follow all activity instructions, and immediately alert a staff member if you have any concerns about your or your child's readiness to participate.

Assumption of risk

You acknowledge and understand that participation in Texas Gaushala events and activities — including as a spectator or bystander — carries inherent risks, including:

  • Physical injury, including severe injury or permanent disability

  • Animal-related incidents (kicking, biting, trampling, startling)

  • Infectious disease or illness

  • Death

You freely and voluntarily assume all such risks — known and unknown — even those arising from the negligence of Texas Gaushala, its staff, property owners, subcontractors, or affiliated parties. You accept full personal responsibility for your participation and that of your children, family, and friends.

Emergency medical authorization

In the event of a bodily injury during participation, you authorize Texas Gaushala and its officers, directors, representatives, agents, and volunteers to authorize emergency medical or surgical treatment deemed to be in the best interest of the injured party, if you are unavailable or unable to do so yourself.

You agree to assume full financial responsibility for all fees and expenses incurred for any such emergency treatment.

Release, waiver, and indemnification

On behalf of yourself, your minor children, heirs, assignees, representatives, and next of kin, you hereby RELEASE, WAIVE, AND HOLD HARMLESS Texas Gaushala, its owner, its officers, directors, employees, agents, volunteers, instructors, subcontractors, and the property owners of 20303 Kickapoo Rd, Waller, Texas 77484 (collectively, "the Released Parties") from any and all claims, demands, causes of action, damages, injuries, or liabilities — including defense costs and expenses — arising from or related to your participation in any Texas Gaushala activity, including any claim alleging that injury was caused by the negligence of any Released Party.

This release is intended to be as broad and inclusive as permitted by law. If any portion is held invalid, the remainder shall continue in full legal force and effect.

Photo and media release

Photographs and videos may be taken during your visit by Texas Gaushala staff or photographers. Texas Gaushala assumes the following preference upon acceptance of the consent form.:

I consent — Texas Gaushala may use photos and videos of my group and me for publicity, advertising, web content, social media, and other promotional purposes.

Facility rules

Texas Gaushala strictly enforces the following rules. Violations will result in immediate removal from the property, with no refund.

  • No smoking or tobacco products of any kind

  • No alcohol consumption

  • No non-vegetarian food or beverages on the premises

  • Follow all posted signage and staff instructions at all times

  • Do not engage in any activity you are not physically comfortable performing

Governing law and dispute resolution

Any claim or dispute arising from or relating to this agreement shall be resolved by binding arbitration under the current rules of the American Arbitration Association. Arbitration shall be held in Harris County, Texas. Judgment on the award may be entered in any court of competent jurisdiction. This agreement is governed by the laws of the State of Texas.

 

Prohibition on Unauthorized Fundraising

Texas Gaushala ("Organization") expressly prohibits any third party, external organization, individual, or entity from soliciting funds, donations, contributions, or any form of financial support in the name of, or on behalf of, Texas Gaushala without the prior written consent of the Organization's Board of Directors.

Fundraising activities conducted in the name of Texas Gaushala or at Texas Gaushala shall be carried out exclusively by a duly authorized member of the Texas Gaushala Board of Directors or by an individual who has received express written authorization from the Board of Directors to act in such capacity ("Authorized Representative").

Any fundraising activity conducted without such prior written authorization shall be deemed unauthorized and a violation of this policy. Texas Gaushala reserves the right to pursue all available legal remedies against any party engaged in unauthorized fundraising in its name.

 

Acknowledgment

I have read this entire form, I understand its terms, and I knowingly and voluntarily agree to all of the above — including the release of liability — on behalf of myself and all members of my group.
